7. Treatment Services & Admissions

7.1  No Guarantee of Admission

Submitting an inquiry or completing an admissions form through this Website does not guarantee admission to any treatment program offered by Emerge Recovery Center. Admission is subject to clinical assessment, availability, insurance verification, medical necessity determination, and other criteria determined at the sole discretion of our clinical team.

7.2  Treatment Agreements

Participation in treatment services is governed by separate clinical consent forms, treatment agreements, financial agreements, and HIPAA authorizations that you will be asked to sign as part of the admissions process. These Terms do not create or modify any treatment relationship.

7.3  Referral Partners

We work with referral partners including healthcare providers, employee assistance programs, and other organizations. These Terms still apply to your use of this Website regardless of how you arrived here. We are not responsible for representations made by any referring party.

7.4  No Emergency Services via Website

This Website is not a platform for emergency services. Do not rely on this Website during a medical or psychiatric emergency. Call 911 immediately.

8. Insurance & Financial Information

Information on this Website regarding insurance coverage, accepted carriers, and estimated costs is provided for general guidance only and is subject to change. Insurance benefits vary by plan, policy year, and individual circumstances. Any insurance-related information you receive through our Website or admissions team is not a guarantee of coverage or payment.

10. SMS / Text Messaging Terms

10.1  Program Description

Magnified Health Systems operates an SMS/text messaging program (the “SMS Program”) to communicate with individuals who have provided prior express written consent. We may send text messages (SMS/MMS) for the following purposes:

• Appointment reminders and scheduling confirmations for treatment sessions
• Admissions process status updates and next-step notifications
• Care coordination and administrative communications related to your treatment
• Insurance verification and financial communications
• Recovery support and wellness check-in messages (where separately consented)
• Promotional and marketing messages about Magnified Health Systems services (only with separate, specific marketing SMS consent)

Participation in any SMS marketing or promotional messaging is entirely voluntary and is NOT a condition of receiving treatment, services, or any other benefit from Magnified Health Systems or Emerge Recovery Center.

10.2  How to Opt In — Express Written Consent Required

We will only send you text messages after obtaining your prior express written consent, which must be obtained separately from your acceptance of these Terms. Consent may be obtained through:

1. Checking a clearly labeled opt-in checkbox on our website, admissions form, or intake paperwork that specifically describes our SMS program
2. Texting a designated keyword to our SMS number, where the opt-in invitation clearly describes the program and message types
3. Signing a written consent form during the admissions or onboarding process that explicitly describes the SMS communications you will receive

CONSENT SEPARATION NOTICE Your consent to receive SMS/text messages is entirely separate from:   •  Your acceptance of these Terms & Conditions   •  Your consent to receive email communications   •  Your clinical treatment consent and HIPAA authorization   •  Your 42 CFR Part 2 substance use disclosure authorizations   You may provide or withhold each of these consents independently without affecting any other.

10.3  How to Opt Out — Reply STOP

You may withdraw your consent and opt out of SMS communications at any time:

• Reply STOP to any text message you receive from us — you will receive one final confirmation message and no further messages will be sent
• Reply CANCEL, END, QUIT, or UNSUBSCRIBE — these are treated equivalently to STOP
• Email [email protected] with a written opt-out request
• Call 833-930-3414 and request removal from our SMS program
• Submit a written opt-out request at https://magnifiedhealthsystems.com/admissions/

After opting out, you will receive a single confirmation text message. No further promotional or marketing messages will be sent. Certain transactional messages directly related to your active and ongoing treatment relationship may continue if separately required.

10.5  Message Frequency

Message frequency varies by program type. Estimated frequency by message category:

10.6  Message & Data Rates

Message and data rates may apply to all text messages sent to and received from us. These charges are determined by your mobile carrier and wireless plan. Magnified Health Systems does not charge any additional fee for participation in our SMS program.

10.7  Supported Carriers

Our SMS program is supported by all major U.S. wireless carriers including AT&T, T-Mobile, Verizon, US Cellular, Boost Mobile, Cricket Wireless, and others. Delivery is not guaranteed on all carriers or in all geographic areas. Contact your carrier if you have issues receiving our messages.

10.8  No Sharing or Selling of SMS Consent

We will NOT sell, rent, share, transfer, or otherwise disclose your phone number or your SMS consent to any third party for their independent marketing or commercial purposes. This is an absolute prohibition with no exceptions.

Your phone number and SMS consent may be shared only in the following narrow circumstances:

• With SMS platform technology vendors who transmit messages on our behalf under written data processing agreements prohibiting any other use of your data
• As required by applicable law, court order, or legal obligation
• In connection with a merger, acquisition, or asset sale, provided the successor agrees to honor these SMS terms

10.9  HIPAA Safeguards for SMS Communications

Because Emerge Recovery Center is a HIPAA-covered entity and a 42 CFR Part 2-regulated program, all SMS communications are subject to the following safeguards:

• We will NOT transmit Protected Health Information (PHI) via standard SMS/MMS. Standard text messaging is not an encrypted, HIPAA-secure channel.
• Appointment reminders and scheduling messages are limited to administrative content (date, time, location, provider name) and will not include diagnoses, treatment details, medication information, or other PHI without your separate written HIPAA authorization.
• Your SMS consent does not constitute a 42 CFR Part 2 disclosure authorization. All disclosures of your substance use treatment information remain governed by your separately executed consent forms and our HIPAA Notice of Privacy Practices.
• You may revoke your SMS consent at any time without affecting your right to receive treatment or services from Emerge Recovery Center.

11. Cookies & Tracking Technologies

Our Website uses cookies, web beacons, pixels, and similar tracking technologies to collect and store information about your interactions with the Website.

16. HIPAA & 42 CFR Part 2 Notice

PROTECTED HEALTH INFORMATION — FEDERAL LAW APPLIES This section summarizes key federal privacy protections applicable to clients and prospective clients of Emerge Recovery Center. It does not replace the full HIPAA Notice of Privacy Practices provided to you separately at admission.

16.1  HIPAA

Emerge Recovery Center is a HIPAA-covered entity. We are required by law to maintain the privacy and confidentiality of your Protected Health Information (PHI) and may use and disclose your PHI only as permitted by HIPAA. You have rights regarding your PHI including the right to access, amend, restrict uses and disclosures, and receive an accounting of disclosures. 16.2  42 CFR Part 2 (Substance Use Disorder Records)

Because Emerge Recovery Center is a federally-assisted drug and alcohol treatment program, records of your identity, diagnosis, prognosis, or treatment relating to substance use disorders are protected by 42 CFR Part 2. These records have protections stricter than general HIPAA records and generally cannot be disclosed without your written consent, except in narrowly defined circumstances such as medical emergencies, court orders with specific required findings, or mandatory child abuse reporting. You may revoke any 42 CFR Part 2 consent verbally or in writing at any time.

16.3  Filing a Privacy Complaint

If you believe your privacy rights have been violated, you may file a complaint with us at [email protected] or with the U.S. Department of Health and Human Services Office for Civil Rights at https://www.hhs.gov/ocr/. You will not be retaliated against for filing a complaint.

17. Governing Law & Dispute Resolution

17.1  Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Where applicable federal law governs (including HIPAA, 42 CFR Part 2, CCPA, and A2P carrier regulations), federal law shall control.

17.2  Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at [email protected] to attempt informal resolution. We will endeavor to respond within 30 days and work in good faith toward a resolution.

17.3  Jurisdiction & Venue

Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Delaware, and you hereby consent to the personal jurisdiction of such courts.

17.4  Waiver of Class Action

To the fullest extent permitted by law, you waive any right to bring claims against Magnified Health Systems as a plaintiff or class member in any class action, collective action, or representative proceeding.

18. Termination of Access

We reserve the right, in our sole discretion, to suspend or terminate your access to the Website immediately, without prior notice or liability, for any reason, including violation of these Terms, conduct that is harmful or disruptive, legal or regulatory requirements, or operational concerns. Sections 4, 13, 14, 15, 16, and 17 will survive any termination.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this document and post the revised Terms on this page. Where appropriate, we will notify SMS program participants of material changes via text message. Your continued use of the Website after posting of revised Terms constitutes your acceptance of those changes.

ENTIRE AGREEMENT

These Terms & Conditions, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Magnified Health Systems with respect to your use of this Website. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
